WEBSITE TERMS AND CONDITIONS OF SALE

These terms and conditions ("Terms") apply to any Products and services You may purchase from Us through Our Website or over the phone. Please read these Terms carefully. We draw Your attention to Your cancellation rights in section 8 and the limits of Our liability in section 9.

1. Words used in these Terms


1.1 In these Terms, reference to:

1.1.1 "Delivery Provider", means as applicable, either Our nominated third party delivery provider or third party suppliers who supply Products sold on Our Website directly to customers;

1.1.2 "Kitchens, Bedrooms and Bathrooms", this is when You have placed an order from Our Kitchens, Bedrooms and Bathrooms range (whether that be a full/entire room or item from that range). In these instances, there are specific terms that apply in addition to these Terms, available here;

1.1.3 "Products" means Our products which may be ordered by You;

1.1.4 "Room Design Solution", this is when You have used Our design software on Our Website (such as the paint calculator or the room design solution).

"Website", means this website: https://www.homebase.co.uk/ ;

"We", "Us", "Our", means HHGL Limited and its subsidiaries. HHGL is a company registered in England and Wales, our company registration number is 00533033 and Our registered office is at Witan Gate House, 500-600 Witan Gate, Milton Keynes, MK9 1BA. Our registered VAT number is 233 1127 55;

"You" or "Your", means You, the customer purchasing the Products.

2. How to contact Us

Our team are online Monday to Sunday 09:00 to 18:00, except Christmas Day, to help with Your queries. You can also call Us on 0333 003 7084, use Our contact form to submit Your query, or write to Us at Witan Gate House, 500-600 Witan Gate, Milton Keynes, MK9 1BA.

3. The contract and contract restrictions


3.1 Changes. We may revise these Terms from time to time. Each time You place an order, You will be asked to agree to these Terms and any additional terms that may be applicable at the point of purchase (e.g. special offers). You should print a copy of these Terms or save them on Your computer device for future reference.

3.2 Acceptance. By placing an order with Us, You are confirming that You accept these Terms. If You do not accept these Terms, You will not be able to purchase any Products from Us.

3.3 Consumers only. By placing an order with Us, You are confirming to Us that You are a consumer and, where purchasing age-restricted Products, that You are at least 18 years old. Our Products are only intended for consumer use (that means people who want to buy Our Products for their personal use and not for any business purposes).

4. Our Products


4.1 Product images. The images of Our Products on Our Website are for illustrative purposes only. Although We have made every effort to ensure that the images are accurate and display Product colours exactly, We cannot guarantee that a device's display perfectly reflects the colour of the Products. Your Product and the packaging may vary slightly from those images.

4.2 Product information. The Product information contained on Our Website has been published in good faith and We will do Our best to ensure that it is accurate. However, it may occasionally be incorrect, incomplete or out of date due to human error or circumstances beyond Our control. Where information is incorrect due to an error or circumstances beyond Our control, We may not accept Your order for the affected Products, or if Your order has already been accepted, We may not supply the affected Products to You. We will notify You if this is the case and will not charge You for the Product (or if You have already made a payment, You will receive a refund).

4.3 Ethical and responsible sourcing. We are committed to ensuring that Our Products are ethically and responsibly sourced. Please see here for further information regarding Our ethical code of conduct.

4.4 Making sure Your information is accurate. Where You provide information to Us (for example if We are customising Products for You or You use Our Room Design Solution), You are responsible for ensuring that the information You provide is accurate.

4.5 Our right to make changes to Products. We may change the Products from time to time: (i) to reflect changes in relevant laws and regulatory requirements; (ii) to implement minor technical adjustments and improvements, for example to address a security threat; or (iii) in response to a Product recall. These changes will not affect Your use of the Products. If We need to make more significant changes to the Products, We will notify You and You may then contact Us to end the contract before the changes take effect and receive a refund for any Products paid for but not received.

5. Order and delivery process


5.1 Orders. You can place orders by following the onscreen prompts on the Website. You will have the opportunity to check and correct any errors in Your order up until the point at which You place Your order by accepting these Terms and clicking the "Submit My Order" button on the order summary page. No changes can be made to Your order after this point unless agreed with Us, by contacting Our customer services team on: 0333 003 7084.

5.2 Payment. Once the above steps are completed, We will take payment from Your chosen payment method. Please note:

5.2.1 if payment is successful, You will receive an order confirmation email containing Your order number and to confirm that We are processing Your order. A contract between us will be formed only when the Products are dispatched to You or when You collect the Products in store (as applicable);

5.2.2 if payment is unsuccessful, You will receive an email letting You know that the payment has failed. We will try the payment again 24 hours later. If payment is still unsuccessful after a third attempt, Your order will be cancelled, and You will receive a cancellation email.

5.3 Rejection of orders. We may choose not to accept Your order for any reason (for example, stock unavailability or incorrect prices on the Website) and We will not be liable to You or to anyone else if We choose not to accept Your order. If payment has been taken and We subsequently cancel Your order in accordance with these Terms, We will refund any monies paid in connection with that order (or that part of the order that We do not accept).

5.4 Deliveries. The following applies to home deliveries:

5.4.1 Delivery costs. The costs of delivery will be notified to You before You place Your order and confirmed in Your confirmation email. Our delivery charges vary according to the value or size of Your order and Your delivery address and may vary between deliveries. Our delivery charges can be found here.

5.4.2 Delivery by third parties. Our Products will be delivered by Our Delivery Providers, therefore We will share Your details so that they can fulfil Your order. Please refer to Our Privacy Policy for more information about how We share Your personal information. Once you have placed your order for the selected products via our website, the products are supplied direct to you by the third-party supplier of the product. The third-party supplier will deliver your items within the lead time stated.

5.4.3 Delivery Window. Except in respect of limited exceptions where Products may be delivered without communication sent to You regarding delivery, once Your order is ready for dispatch, You will receive communication by either email, text message or telephone from either Us or the relevant Delivery Provider to confirm the estimated date and time for when the Products will be delivered to You ("Delivery Window").

5.4.4 Changes to Delivery Windows. If You want to amend Your Delivery Window, please contact the relevant Delivery Provider. Alternatively, You can contact Us on: 0333 003 7084. We will do Our best to offer an alternative delivery date but this isn't guaranteed.

5.4.5 Separate Deliveries. Products ordered together may arrive in separate deliveries and/or delivered on different dates.

5.4.6 Doorstep or Kerbside Delivery. Except in relation to deliveries for Kitchens, Bedrooms and Bathrooms, all Products will be delivered to Your doorstep or kerbside only. We are not responsible for any additional lifting or carrying of Your Products. Delivery does not include fitting, removal or disposal of packaging or waste disposal, unless We have agreed otherwise in writing.

5.4.7 Delivery Restrictions. You must let Us know if there are any delivery restrictions that may prevent access to Your property as well as any health and safety issues We should be aware of.

5.4.8 Missed/failed deliveries. If no one is available at Your address to take delivery or We cannot deliver the Products due to access issues You didn’t inform Us about and the Products cannot be posted through Your letterbox, Our Delivery Provider will leave You a delivery card or contact You informing You of the attempted delivery and how to re-arrange delivery.

5.4.9 Missed/failed delivery fee. We will be happy to re-arrange a new delivery date in these circumstances, however We reserve the right to charge an administration fee (currently charged up to £150, but may be subject to change). If, after a failed/missed delivery to You, You do not re-arrange delivery, We may end the contract with You.

5.4.10 Restrictions on delivery areas. We can only deliver in the following geographical areas: mainland England, Scotland and Wales. In some circumstances We may be able to deliver to some parts of Northern Ireland and the Republic of Ireland. You can check whether We deliver a Product to Your area by entering Your postcode online at the point of check-out.

5.4.11 NDD. We cannot always guarantee Next Day Delivery or Named Day Delivery to specific addresses. You will be informed before placing Your order whether Next Day or Named Day Delivery is available to Your address.

5.4.12 After delivery. If any parts are missing from Your delivery and/or damaged or defective, please let Us know within 14 days of Your delivery. Once We have verified that Your delivery contained missing and/or damaged or defective parts, We will provide replacement parts and agree with You a time and date for delivery or collection (as applicable) of those parts. If the missing and/or damaged part is out of stock, We will refund You the cost of the missing or damaged/defective part.

5.4.13 Certain Delivery Providers. For smaller deliveries made by certain Delivery Providers, You will receive a text message with a link for either the Delivery Provider's website or the Delivery Provider's app, where You can give specific instructions in respect of Your delivery requirements, for example, to leave the delivered Product(s) at a safe location or with a neighbour. In some circumstances, if You do not add specific delivery instructions and there is nobody at Your property, the relevant Delivery Provider will leave Your Products in an appropriate safe place.

5.5 Click & Collect. If You have placed an order for collection in store ("Click & Collect") You can collect them at any time during Our store opening hours after receiving a confirmation text that Your order is ready for collection from Your chosen store. For information about Our store opening hours see STORE OPENING HOURS. In addition:

5.5.1 Your Click & Collect Product will typically be available to collect in Your chosen store within 1 hour (subject to store opening times) after placing Your order. During busy times it may take Us longer to process Your order. Your collection time is not confirmed until You receive a text;

5.5.2 if there are any issues with Your order, We will be in contact to discuss these with You before you are asked to collect from the store;

5.5.3 We will hold Your order for up to 5 days from the date You placed Your order. We will send You a reminder text message the day Your order is due to expire. If You are unable to collect Your order within 5 days, Your order will be cancelled, and We will process a refund;

5.5.4 When You come to collect Your Product from Your chosen store, You (or someone acting on Your behalf) will need to bring Your order number. Your Product will be available for collection at Your chosen store's customer services desk.

5.6 Product unavailability/order cancellation. If for any reason We cannot provide You with a Product in Your order, You will be contacted by telephone or email and a refund will be issued for the amount You paid for such Product, including any relevant delivery charges paid if the order contained only that Product. This might be because the Product is out of stock, because of unexpected limits on Our resources which We could not reasonably plan for, or because We have identified an error in the price or description of the Product.

6. Price and payment


6.1 Prices. The price of the Product (which includes VAT) will be the price indicated on the order pages when You placed Your order, except in cases of obvious error.

6.2 VAT changes. If the rate of VAT changes between Your order date and the date We supply the Product, We will adjust the rate of VAT that You pay, unless You have already paid for the Product in full before the change in the rate of VAT takes effect.

6.3 Errors in pricing. It is possible that, despite Our best efforts, some of the Products We sell may be incorrectly priced. If this is the case, We will, at Our discretion, either contact You for instructions before dispatching the Product, or reject Your order and notify You of such rejection.

6.4 Making payment. You must pay for the Products before We dispatch the Products. You can pay for the Products by using most major online payment methods (including checkout.com, WorldPay, PayPal, Klarna, Apple Pay and Google Pay).

7. Providing the Products


7.1 We are not responsible for delays outside Our control. If Our supply of the Products is delayed by an event outside Our control, We will contact You as soon as possible to let You know and We will take steps to minimise the effect of the delay.

7.2 When You become responsible for the Products. A Product will be Your responsibility from the time the Products are delivered to the address You gave Us (either initially or if You agree different delivery instructions with the Delivery Provider). If You provide Us with an incorrect delivery address and Your order is signed for by someone else, or if the intended recipient is no longer resident or employed at the delivery location You specify, you are responsible for any losses You may incur as a result of, for example, theft of the Products.

7.3 When You own Products. You own a Product once We have received payment in full and the item is correctly delivered or collected, unless due to unforeseen circumstances We cancel Your order as set out in these Terms.

8. Your Rights - Cancellation, Returns and Refund


8.1 What You have purchased is faulty, damaged or incorrect or any services have not been performed properly:

Your rights: If the Product purchased is faulty, damaged or incorrect, We may offer You a repair, exchange or refund as appropriate.

If any services We provide have not been performed properly, We may offer to re-perform the services.

We are under a legal duty to supply Products that are in conformity with the contract.

The Consumer Rights Act 2015 says:

• goods must be as described, fit for purpose and of satisfactory quality. During the expected life of Your Product Your legal rights entitle You to the following:

― up to 30 days: if Your goods are faulty, then You can get a refund;

― up to 6 months: if Your faulty goods can't be repaired or replaced, then You are entitled to a full refund, in most cases;

― up to 6 years: if the goods can be expected to last up to 6 years You may be entitled to a repair or replacement, or, if that doesn't work, some of Your money back.

These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.adviceguide.org.uk or call 03454 04 05 06.

What You need to do: Please check Your order for faulty, damaged, incorrect or missing Products, within 14 days of deliver of Your order.

Please contact Our customer service team on 0333 003 7084 or email Us at customerservices@homebase.co.uk to discuss the issue with the Products purchased and which of Your legal rights You wish to exercise.

Your statutory rights remain unaffected.

If you wish to exercise Your legal rights to reject Products, please provide Your name, home address, details of the order and, where available, Your telephone number and email address to Our customer service team on: 0333 003 7084.

What We will do: Our customer service team (contactable on: 0333 003 7084) may be able to arrange for the Products to be collected by the Delivery Provider that delivered the Products to You.

Please note that We may not be able to arrange the collection of some Product(s) for return to Our stores. Please contact Our customer services team on: 0333 003 7084 to confirm the correct method of return of Your Product(s) before attempting to return Your Product(s).

We will refund You the price for the Products, including delivery costs and the costs of return, by the method You used for payment as soon as We can. If the method You used for payment has expired in the intervening period, We will refund You the price You paid for the Products by cheque.

8.2 You have changed Your mind…:

Your rights: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, for most Products bought online You are entitled to cancel the contract provided that You exercise Your right to cancel no longer than 14 days after the day on which You receive the goods or services.

Exclusions:

Your right to cancel does not apply in respect of Products which are made to Your specification or personalised.

Your right to return or cancel Products does not apply to Products sealed for hygiene or health protection purposes (once these have been unsealed after You receive them).

This doesn't affect Your statutory rights if the Products are faulty or not as described.

Our Goodwill Guarantee: We have decided to extend this and allow You 30 days to change Your mind and return the Products.

Exclusions:

Your right to cancel does not apply in respect of Products which are made to Your specification or personalised. Any samples purchased through our website or stores are also excluded.

What you need to do: If You wish to exercise Your right to cancel and arrange collection of the Products to be returned, please contact Our customer service team on 0333 003 7084 or email Us at email Us at customerservices@homebase.co.uk. Please provide Your name, home address, details of the order and, where available, Your telephone number and email address. To make the process easier, You can use the model cancellation form accessed here.

The Products must be returned to Us within 30 days of telling Us You wish to end the contract, in a new, unopened, unsealed and unused condition (other than where necessary to inspect) and wherever possible in the original packaging.

Except in relation to the limited circumstances regarding Products ordered from Our Kitchens, Bedrooms and Bathrooms range (please see Appendix 1 (Kitchens, Bedrooms and Bathrooms) for more details), if You prefer, You can return Your Product in store. Returning Your Products to store is easy. In addition to the above, all You need to do is bring the following:

(a) Your receipt or order confirmation; and

(b) the payment card You used to purchase or place Your order with.

What We will do: Our customer service team (contactable on: 0333 003 7084) may be able to arrange for the Products to be collected by Us or the Delivery Provider that delivered the Products to You.

Please note that We may not be able to arrange the collection of some Product(s) for return to Our stores. Please contact Our customer services team on: 0333 003 7084 to confirm the correct method of return of Your Product(s) before attempting to return Your Product(s).

If We are able to collect Your Product, We would be happy to arrange collection for a charge of £50.

We will refund You the price for the Products and/or services (delivery fees are non-refundable), by the method You used for payment. If the method You used for payment has expired in the intervening period, We will refund You the price You paid for the Products by cheque.

We may make a deduction from the refund for any loss in value of the Products, if the loss has been caused by unnecessary handling by You.

The time to receive Your refund depends on when and how Your item was returned:

• Returning in-store – Your refund will appear in Your account within 3-5 days.

• Returning via a collection – Please allow up to 7 days for this to appear in Your account, once Your items have been collected.

Regardless of return method, We will refund You no later than 14 days after the day You exercised Your right to end the contract.

For Products supplied directly to You by a third party, We may refer Your query to their customer service team.

8.3: You want to end the contract because of something We have done…:

Your rights:

Reasons for wanting to end the contract include:

• We have told You about an upcoming change to the Product or these Terms which You do not agree to;

• We have told You about an error in the price or description of the Product You have ordered and You do not wish to proceed;

• there is a risk that supply of the Products may be significantly delayed because of events outside Our control;

• We have suspended supply of the Products for technical reasons, or We notify You that We are going to suspend them for technical reasons, in each case for a period of more than 14 days; or

You have a legal right to end the contract because of something We have done wrong.

What You need to do: To end the contract for this reason and arrange collection of the Products to be returned, please contact Our customer service team on 0333 033 7084 or email Us at:

Please provide Your name, home address, details of the order and, where available, Your telephone number and email address.

What We will do:

Your contract will end immediately and We will refund You in full for any Products which have not been provided or have not been provided properly no later than 14 days after the day You exercised Your right to end the contract.

Our customer service team (contactable on: 0333 003 7084) will then arrange for the Products to be collected by Us or the Delivery Provider that delivered the Products to You.

We will refund You the price for the Products and/or services, including original delivery costs and the costs of return, by the method You used for payment as soon as We can. If the method You used for payment has expired in the intervening period, We will refund You the price You paid for the Products by cheque.

9. Our responsibility for loss or damage suffered by You


9.1 We are responsible to You for foreseeable loss and damage caused by Us. If We fail to comply with these Terms, We are responsible for loss or damage You suffer that is a foreseeable result of Our breaking this contract or Our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both We and You knew that it might happen, for example, if You discussed it with Us during the sales process.

9.2 We do not exclude or limit in any way Our liability to You for death or personal injury caused by Our negligence, or Our responsibility for fraudulent misrepresentation and any other liability that cannot be excluded by law.

9.3 When We are liable for damage to Your property. If We are accessing Your property to provide Products and/or services, We will make good any damage to Your property caused by Us while doing so. However, You are responsible for ensuring that Your property is prepared and accessible for delivery including ensuring that there is sufficient room for the Product(s) and the Delivery Provider(s) to deliver the Product(s). We are not responsible for the cost of: (a) repairing any pre-existing faults or damage to Your property that We discover while providing the services; or (b) damage caused by third party service providers such as delivery personnel in which circumstances please contact the third party provider (Our customer services team, contactable on: 0333 003 7084, can provide details if required).

9.4 We are not liable for business losses. We only supply the Products for domestic and private use. If You use the Products for any commercial, business or re-sale purpose We will have no liability to You for any business loss (which includes loss of profits, contracts, goodwill, opportunity and other similar losses).

9.5 We do not accept any additional losses that may arise from late deliveries, incomplete orders or items, or damaged Products. We will be liable for any faulty or missing Products as set out above, but We will not be liable for any consequential losses that may occur as a result of the delay in delivery (for example, loss of use, costs of third parties, time off work etc.) unless such consequential losses are caused by Our acts or omissions. Please do not remove existing fittings or book, confirm or instruct any third parties to complete any works relating to the Products or rely upon the delivery date to start the works until You have received Your Products, checked that they are complete and conform to Your requirements.

10. Product guarantees and warranties


Our Products may come with guarantees or warranties. Excluding Our branded Products, these are promises between You and the manufacturer only, not with Us. Please review any guarantee or warranty documentation carefully and complete any after-sale steps required.

11. Contracting with third parties


In some instances, We may display Products and/or services on Our Website that are provided directly by a third party to You (Third Party Services). In these instances, You will either be directed to that third parties' website, provided with their contact details, or We will provide You with the third party terms applicable to Your order. In these instances, the contract is between You and that third party and not Us. We accept no liability or responsibility for Your contract of sale (or any issues or claims You may have) relating to the Third Party Services. If You have any issues with the Third Party Services, We will try to help resolve the issue, but We are under no obligation to do so.

12. Other important terms


12.1 How We will use Your personal information. We will use the personal information You provide to Us:

12.1.1 to supply the Products to You;

12.1.2 to process Your payment for the Products; and

12.1.3 if You agreed to this during the order process, to give You information about similar Products and/or services that We provide, but You may stop receiving this at any time by contacting Us.

12.2 We will only give Your personal information to third parties where the law either requires or allows Us to do so.

12.3 You need Our consent to transfer Your rights to someone else. You may only transfer Your rights or Your obligations under these Terms to another person if We agree to this in writing.

12.4 Nobody else has any rights under this contract. This contract is between You and Us. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person to end the contract or to make any changes to these Terms.

12.5 Even if We delay in enforcing this contract, We can still enforce it later. If We do not insist immediately that You do anything You are required to do under these Terms, or if We delay in taking steps against You in respect of Your breaking this contract, that will not mean that You do not have to do those things and it will not prevent Us taking steps against You at a later date.

12.6 Which laws apply to this contract and where You may bring legal proceedings. You and We agree that English law applies to these Terms and that any dispute between us arising out of or in connection with these Terms will only be dealt with by the English courts, unless You live in another part of the UK or Republic of Ireland, in which case the applicable law of that part of the UK or Republic of Ireland will apply and any dispute will be brought before the courts of that part of the UK or Republic of Ireland.

12.7 Complaints. If You have a complaint regarding the Products supplied by Us to You, please see here for more information on how to make a complaint.

Alternative dispute resolution. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without You having to go to court. If You are not happy with how We have handled any complaint, You may want to contact the alternative dispute resolution provider We use. You can submit a complaint to The Furniture and Home Improvement Ombudsman via their website at https://www.fhio.org/ The Furniture and Home Improvement Ombudsman will not charge You for making a complaint and if You are not satisfied with the outcome You can still bring legal proceedings.

Appendix 1 – Kitchens, Bedrooms and Bathrooms

If Your order is from Our Kitchens, Bedrooms and Bathrooms range, the following additional terms apply to Your order:

1. Delivery. You are responsible for ensuring that Your property is prepared and accessible for delivery including ensuring that there is sufficient room for the Product(s) and the Delivery Provider(s) to deliver the Product(s). When Your purchase is for an entire room, We will aim to deliver Your Product(s) as part of Your purchase to Your room of choice, but in some circumstances this may not always be possible, including as set out under section 2 below. In order for Us to deliver to Your room of choice You must let the Delivery Provider know the following when booking Your delivery:

1.1 if there are any access restrictions to the room of Your choice;

1.2 if You live in an apartment, and provide details about the floor and access including details of any lift; and

1.3 if there are any health and safety issues such as building works.

2. Delivery exceptions. Whilst We aim to deliver to Your room of choice, this may not always be possible in some circumstances, for example, if Your order contains a large Product and there are issues with access, the type of Product purchased (e.g. smaller items), the Delivery Provider used or if You do not give Us the required information mentioned in section 1 above. In these instances We reserve the right to deliver doorstep or kerbside only. Where We are unable to deliver to Your room of choice, We will notify You prior to delivery of Your order. For smaller items, We may only deliver as a doorstep or kerbside delivery.

3. Missed deliveries. Please make sure that someone is at home during the Delivery Window to accept the Product(s). We will make at least 3 attempts to contact You to re-arrange Your delivery and in the unusual circumstances that We cannot contact You, We may need to cancel Your order and provide You with a refund. Please note that there may be an administration charge payable for re-delivery.

4. Appliances

4.1 Installation of appliances. If Your order includes installation of appliances, We recommend You book delivery for after Your kitchen is installed.

4.2 Recycling. If You have requested Us to recycle Your old appliance, You must ensure it is disconnected safely by a qualified professional and ready for Us to collect. We recommend you store the appliance inside after it is disconnected.

5. Fitting. In some instances We may provide a list of independent installers that You may wish to use to fit Your order. This list is provided "as is" and We take no responsibility for any works carried out by such third parties. We recommend that You should await receipt of Your delivery in full and check all items are in a good condition (including removal of packaging where required) prior to booking Your installer. When You contract with those third parties, You are doing so at Your own risk and Your contract for the fitting service will be direct with the fitter and not Us.

6. Returns. We do not accept returns of any items purchased from Our Kitchens, Bedrooms and Bathrooms to Our store, except in respect of some smaller items. If You wish to return an item purchased from Our Kitchens, Bedrooms and Bathrooms to Our store, please contact Our customer services team on 0333 003 7084 who will assist in confirming if the item is too large to return to Our store.

Where You have used Our Room Design Solutions:

7. Accuracy of the final plan. Our Room Design Solution is a tool provided free of charge and is there to assist You with planning Your room design and/or calculating the required number of Products necessary for Your room design. It is provided "as is", meaning We give no guarantee as to any results generated and You use it at Your own risk. It is Your responsibility to ensure the measurements You provide are accurate. Once the plan has been designed or You have been given an estimated number of units, You will be responsible for checking the accuracy and suitability of the plan and units specified to ensure it meets Your requirements as well as any resulting quotation before committing yourself to an order. We will not be responsible for any errors in the final design or inaccuracy of the measurements.

8. Ownership of design plans. We own any rights in the design plan and they may not be reproduced in whole or in part without Our prior written consent. Our plans may only be used by You in order to obtain a quotation by Us or to place an order with Us. You assign to Us all rights in and to any designs, plans or other similar materials created by You using Our Room Design Solution.

9. Availability of Our Room Design Solution. We may, from time to time, restrict access to or remove certain features or parts of Our Room Design Solution, or the entirety of Our Room Design Solution. There may also be times when Our Room Design Solution or certain features of it become unavailable. We will not be liable to You or to any third party for any withdrawal, suspension, modification, unavailability, inaccessibility or discontinuance of Our Room Design Solution.
