Retail Group (as defined in the privacy policy) shall have the right to enforce

under these terms and conditions and take the rights or benefits of
any limitation or exclusion or limitation of liability in these terms and conditions;
b) a person/entity
who is a permitted successor or assignee under Section 4.3 above of
the rights or benefits of these terms and conditions may enforce such rights

and no consent from such person/entity is required for the parties
